Acceptance of these terms

These Terms of Use ("Terms") govern your use of this website and the mobile applications published by Despina ("we", "us"), together the "Services". By using the Services you agree to these Terms. If you do not agree, please do not use the Services.

Using the Services

You may use the Services for personal, non-commercial purposes in accordance with these Terms and applicable law. You agree not to:

• copy, modify, distribute, sell or lease any part of the Services;
• reverse-engineer or attempt to extract the source code of our apps, except where the law expressly permits it;
• use the Services in any way that could damage, disable or impair them, or interfere with other users;
• use automated means to access the Services without our permission.

App stores

Our apps are distributed through Apple's App Store and Google Play. Your use of an app is also subject to the applicable store's terms, including Apple's Media Services Terms and the Google Play Terms of Service. Apple and Google are not responsible for our apps or for any claims relating to them.

Purchases and subscriptions

Some apps offer in-app purchases or subscriptions. All payments are processed by Apple or Google under their terms; we do not collect or store payment details. Subscriptions renew automatically unless cancelled before the end of the current period (on the App Store, at least 24 hours before it ends), and can be managed or cancelled in your App Store or Google Play account settings. Refunds are handled by the relevant store according to its policies.

Intellectual property

The Services — including software, design, text, graphics and logos — are owned by us or our licensors and are protected by copyright, trademark and other laws. Nothing in these Terms grants you any right to use our names, logos or branding. Content you create in an app remains yours.

Updates and availability

We may update, change or discontinue any part of the Services at any time. We aim to keep our apps compatible with current operating system versions, but we cannot guarantee that every feature will remain available on every device indefinitely.

Disclaimer of warranties

The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Services will be uninterrupted, error-free or secure.

Limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits or goodwill, arising out of or in connection with your use of the Services. Our total liability for any claim relating to the Services will not exceed the amount you paid us, if any, in the twelve months before the claim arose.

Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

Termination

We may suspend or terminate your access to the Services if you breach these Terms. You may stop using the Services at any time by uninstalling our apps. Sections that by their nature should survive termination — including intellectual property, disclaimers and limitation of liability — will continue to apply.

Governing law

These Terms are governed by the laws of the jurisdiction in which Despina is established, without regard to conflict-of-law rules. Any dispute will be resolved in the courts of that jurisdiction, unless applicable consumer law gives you the right to bring a claim elsewhere.

Changes to these terms

We may revise these Terms from time to time. The "last updated" date above shows the latest version. Continued use of the Services after a change means you accept the revised Terms.
